Thirdly I give and devise to my son Benjamin all that my whole repage and tenement situate lying and being the whole of the south half and the East part or half of the North half of Lot No twenty four in the twelfth concession of the Township of Hungerford, Victoria District containing one hundred and fifty acres be the same more or less to have and to hold to my said son Benjamin his heirs and assigns forever
Fourthly I give and devise to my son John Nelson the west half of North half of Lot No twenty four in the twelfth concession of the Township of Hungerford, District and Province containing fifty acres be the same more or less to have and to hold to my son John Nelson his heirs and assigns forever.
And finally all the rest residue and remainder of all my affects real and personal whatsoever and whomsoever not herein before mentioned or disposed of ( after payment of my debts, legacy, funeral expenses and other charges as aforesaid ) I do give and bequeath unto my beloved wife Elizabeth whom I hereby appoint sole executrix of this my last will and testament. Second - I give devise and bequeath to my son Wilbert Stanley Maybee all of my Real estate in lot number sixty in the second Concession of the aforesaid Township of Ameliasburgh subject however to any and all charges and legacies hereinafter mentioned.
Third - I give and bequeath to my said wife Hannah Mariah Maybee,
Wilbert Stanley Maybee and William Henry Maybee my two sons the whole of my personal estate of whatsoever character or description it may be - to be equally divided between them share and share alike, but my said wife shall have the full control of the said personal estate and the management of the same for the support and education of my children and her own support till my said son Wilbert Stanley Maybe shall attain to the age of twenty four years at which time the said property that is the personal estate shall be divided as aforesaid.
Fourth - I give to my said wife the full control of my real estate
aforesaid for her own support and the support of my said sons while she shall remain unmarried and my widow.
Fifth - I give and bequeath to my son William Henry Maybee one hundred dollars a year during his natural life and I make the same a charge on the lands and tenements hereinbefore willed to my son Wilbert Stanley Maybee and I hereby authorize my Executrix and Executors if necessary to secure the payment of the said legacy to sell and convey to a purchaser or purchasers so much of the said Real estate as will secure such yearly payments to him but I make this special provision that while my said wife and my son Wilbert Stanley Maybee or either of them shall afford and provide my said son William Henry Maybee a comfortable home and a comfortable living on the said Real estate or homestead farm the said legacy of a hundred dollars a year shall not run against the said Real estate or be payable to him but the said comfortable home and living shall be in lieu of the said legacy.
My Estate Real and personal shall be liable for my debts funeral
expenses and cost of monument. My real estate is willed to my son
Wilbert Stanley his heirs and assigns forever - but in all Cases subject to all the aforesaid provisions.
In witness whereof I have hereunto set my hand and seal this thirteenth day of September in the year of our Lord one thousand eight hundred and seventy eight.

"This is a codicil to the last Will and Testament of me Anson G Mabee of the Township of Ameliasburgh in the County of Prince Edward and Province of Ontario yeoman bearing date the thirteenth day of September 1878.
I do hereby revoke the appointment of ny Nephew Willet Maybee yeoman of the Township of HIlliar [sic] to be an Executor to my last Will and Testament. And I do hereby Constitute and appoint My Brother in Law John Calnan of the Township of Hilliar [sic] in the County of Prince Edward yeoman to be an Executor to my last Will and Testament and I do declare that the Word "Suitable Monument" in the 1st Section of my said Will shall mean nothing more than such a Tomb Stone as my Executors may see fit to erect. In all other respects I do confirm my last Will in ? whereof [ink blot] to set my hand and seal this 12th day of January AD 1879.

Anecdote*1891 Hial N. Maybee, nurseryman and orchardist, near Lakeport, was born in Canada, Aug. 06, 1835. His parents were natives of Duchess County, New York, and moved to Canadian then back to Michigan.
Hial received a common-school education while at home with his parents in Michigan. He afterward attended Bacon, Bryant and Stratton's Mercantile College in Cincinnati, where graduated in 1859. He then went to Steven's Point Wisconsin, where he engaged in the wholesale lumber business, in partnership with his brother. He remained in Steven's Point until 1865. In the spring of that year he sold out and went to New York city, where he took passage on the Steamer "Golden Rule", which was wrecked on Ronkador, on French Keys, May 29. There were 1000 passengers' aboard, all of whom excepting one escaped to the reef, where they subsisted of eleven days. On June 9 they were rescued by the gunboat Georgia, and taken to Aspinwall. from where they came to California and arrived in San Francisco, July 1. Mr. Maybee first settled in Nevada, Marin County, where he bought land and engaged in dairying for seven years. In 1872 he sold our and went to Alameda, where he engaged in contracting and building. In 1876 he went to Buckeye Valley, five miles west of Ione in Amador County, where he engaged in farming and nursery business. He also worked at some carpentering, having secured several contracts from the railroad company. In 1881 he returned to Alameda, where he again followed the business of contracting and building for two years. In 1883 he came to Lake county and bought land two miles south of Lakeport, where he now resides. He has forty-one acres of land, which he devotes principally to nursery and small fruits. He has a nursery stock of abut 50,000 trees. He has one acre planted in strawberries of different varieties, which yield and enormous quantity of luscious fruit. He also has blackberries, currants and other small fruits, the acreage of which is increasing each year. He has two fine, flowing artesian well on his premises; also an excellent spring from which he conducts water to his residence through pipes for general uses.
Mr. Maybee has been married twice. He first wife was a Mrs. Carpenter, of Lincoln County Maine, to whom he married in 1873, and who lived only a short time after their marriage. In 1885 he was married to Mrs. Myers, a native of Germany. She had two daughters from her first marriage, who are living in the old country. Mr. Maybee is a member of IOOF and AOUW.12

Whereas Albert Lewis Smith of the Town of Belleville in the County of Hastings Esquire, a creditor of said deceased by petition to said Court set forth that the said deceased died at Belleville in said County Intestate, that he is a creditor of said deceased by virtue of a certain judgement resolved in her Majesty's Court of Queens Bench at Toronto wherein one John O'Hare now deceased was plaintiff and one Alfred Maybee and the said deceased were defendants for the sum of one hundred and twelve pounds eleven shillings and six pence damages and costs, and said petitioner is desirous of obtaining limited administration of the personal estate and effects of said deceased that he may be able to realize the amount of the said judgement out of the real estate of the said deceased.

Whereas Albert Lewis Smith of the Town of Belleville in the County of Hastings Esquire, a creditor of said deceased by petition to said Court set forth that the said deceased died at Belleville in said County Intestate, that he is a creditor of said deceased by virtue of a certain judgement resolved in her Majesty's Court of Queens Bench at Toronto wherein one John O'Hare now deceased was plaintiff and one Alfred Maybee and the said deceased were defendants for the sum of one hundred and twelve pounds eleven shillings and six pence damages and costs, and said petitioner is desirous of obtaining limited administration of the personal estate and effects of said deceased that he may be able to realize the amount of the said judgement out of the real estate of the said deceased.
