Anecdote |
25 May 1910 |
Amsterdam, Montgomery County, New York [8] |
- George E. Mabee, a sub-foreman, employed at the Speir Falls power plant, was killed by electricity on November 16, 1908, while at work at the plant and action for $25,000 damages was begun by his widow, Florence M. Mabee against George W. Dunn, et al., receivers of the Hudson River Water Power company. Trial of the action was begun In supreme court Monday afternoon before Justice Kellogg.
The plaintiff's intestate was a shift foreman, having charge of the plant for a tour of eight hours with four men under him. It is alleged that when he was killed that be was engaged in the work of removing a current transformer, which was useless, and was doing the work under the personal direction of Superintendent Anderson and that through the negligence of the superintendent, Mabee met his death. Mr. Anderson received a severe shock at the same time and was unconscious for a while.
Defendant claims there was no negligence on its part and that the deceased assumed the risks of the employment and was aware of all the dangers, having been foreman for a year and a half prior to his death.
When the trial of the case was resumed Tuesday, on motion of Attorney Curtis, the court granted an order allowing the receivers to settle with the plaintiff for $1,500 and the action was withdrawn.
