- I, Joseph Mabee of the Town of North Castle, in the County of Westchester County, being of sound and disposing mind and memory do make this my last Will and Testament as follows, to wit, the house where I have late dwelt I give to my Brother-in-law, Abraham Miller to him and to heirs and assigns forever - My wearing apparel I give equally to my two brothers, Stephen and John Mabee the remainder of my movable property together with the remainder of my real estate I order to be sold at the discretion of my executor herein after named and after all my just debts and necessary charges being then paid out of any monies of my estate that may come into their hands then the amount of my estate when cleared of all encumbrances I order three hundred dollars to be put to the interest for the benefit of Sally Mabee, being the daughter of Aimy Merritt to be paid to her both principal and interest when she shall arrive to the age of twenty one years – To my two aforesaid brothers Stephen and John the sum of fifty dollars each. I give to them and to their heirs. To my sister Fanny Wyatt I give the sum of twenty five dollars and to her heirs – and to James Mabee the son of my brother Isaac I give the sum of twenty five dollars when he shall be twenty one years of age. The residue of my estate I then order to be put to the interest for the benefit of James M Miller, son of the aforesaid Abraham Miller to be paid to him both principal and interest when he shall have attained the age of twenty one years, but if either th said James M Miller or the said Sally Mabee should die before they are twenty one years of age, then such parts of my estate hereby given to them shall be equally divided between my two said brothers Stephen and John Mabee, my sister Fanny Wyatt, the said Abraham Miller's children as one are and to the said James Mabee or to the survivors ... In Witness Whereof I have herewith set my name ans seal this twenty eighth day of September in the year of our Lord one thousand eight hundred and sixteen.
