Mrs. Wilson his grandmother took charge of the child and has reared him from his birth.
The father, John J. Maybee, applied to the Surrogate and was appointed general Guardian of his son. Then he got am order from the Surrogate directing the administrators, who were Mrs. Wilson, and M. N. Dodge, to pay to John J. Maybee, as general guardian of Harry, from the estate of Burr Wilson, a sum not exceeding $1500. They actually paid him $1800, which he drew from the estate arid receipted for.
As soon as he got that money he went to Ireland and squandered the money, and Mrs. Wilson has had to provide for the child all its life. All that he has ever done for the child has been to provide one suit of clothes which he ran in debt for and Mt without paying for them.
This last spring he got himself, with John Johnston, appointed administrator of the estate of his deceased wife.
The proceeding on Monday was on a final accounting of the administrators of Burr Wilson's estate. Senator Thornton represented the administrators and Benjamin Reynolds the administrators of the dead wife of Maybee.
Mr.. Reynolds contention was that the payment of $1800 which the administrators claimed credit for, was a legal payment, and that the administrators were entitled to a decree directing that money to be paid to them. A petition will be presented for the removal of Maybee and for the appointment of another guardian; and then the question as to tho liability of Maybee's sureties will be considered.
April 24, 1903
In the matter of the final judicial settlement of the estate of Hattie O. Maybee, the Surrogate has filed a decision settling the accounts of the administrators as filed and holding that the moneys paid to John J. Maybee from the estate of Burr Wilson deceased were legally in his hands as such guardian and never came in the possession of the administrators of Hattie O. Maybee as a part of her estate.8
